Qualifications or Race and Gender?

Justice Stephen Breyer "announced" his leaving from the Supreme Court at the end of the current term. His leaving was announced for him apparently from a leak, which caught him off guard, but neither Breyer nor the Supreme Court has officially announced anything yet, regarding his leave. Now, the question is, who is going to replace him if he does indeed leave the Supreme Court? Well, Biden said it himself during his campaign in 2020. You can see from this clip that he stated it would be a Black Woman(with the right qualifications).

The problem with what he said was that it would be a Black Woman. Why should it matter if the person is Black, White, Asian, Hispanic and male or female? It should be a person with the right qualifications(like Biden stated in the clip), but the race and/or gender of the person should be irrelevant. This clearly violates Federal Civil Rights Law, you can't say anywhere else that "I want a white male for x seat", that's what makes this so disturbing.

 

I wanted to get everyone's thought's on what Biden said, especially considering the current situation. Does it really matter what race and gender someone is, or are the qualifications more important in today's society?

Prior to the Biden administration, no women were vice presidents. As a result, why should we stick to the convention of every political figure being an old, white male?

Yes, it does. It is not only important to have a diverse court, but also to have diversity in every aspect of society. If there's only white men presiding over the courts, they'd be making judgments from their shared lived experiences, with a lack of empathy, understanding, or lived experience on the vast array of populations they fail to represent. It is important to have a black and female justice, as 14% of the population of the US is black, and a little over 50% is female. Biden saying he is going to elect the first black and female justice is a step in the right direction, don't think just because he said that that qualifications are thrown out the window- Why would you even assume that?

 

The name being thrown around for the nominee to replace Breyer is Ketanji Brown Jackson, who seems to have an esteemed reputation of being a circuit judge, and clerking under Justice Breyer for a few years. 

 

When non-hispanic white americans make up only 60% of the population of the US, it is unfortunate to have a Supreme Court with a 77% white majority- a clear example of structural and systematic racism. If you want to go a step further, you have females who make up 50% of the population but only have a 33% representation on the court-  a clear example of societal discrimination

What will be interesting to see is if the senate (Dem controlled atm) cannot get its shit together before the midterms to get the nomination through, which it will then stall due to malign neglect as the democrats are surely to lose the midterms in November.

The real pressing issue is why 75% of the NBA is black men despite only accounting for 7% of the population. You should get on that.

 

You want to pick the people most qualified for the job, regardless of other aspects. This the intergalactic council. If you push for the idea that every culture, color, religion, whatever needs enough people to accurately reflect their portion of the population, you're never going to have enough seats. I don't see any Indians there, but nobody seems to be up in arms about it.

The Civil Rights Act of 1964 prohibits discrimination on the basis of race, color, religion, sex or national origin.

 

This isn't discrimination, the goal of Biden's statement is to actually push forward the opposite. He wants a black woman for the sake of diversity in the Court. Do I fully agree with narrowing your candidates from the start? Not necessarily, but it's also not necessarily a bad thing to aim to bring in a woman of color to the court. As long as whoever is brought in has the merit to back up their selection, I could care less.

It doesn't matter who it is, I want the person with the right qualifications regardless of age, race or gender. As long as they can do their job right(according to your views in politics that is), I'll be fine with whoever is chosen.
