Any Lawyers out there?

My ex-girlfriend and her grandmother are threatening to take me to court to pay for my ex's hospital bills. She got pregnant last June and we found out that she has a rare genetic condition in which her body can't support a baby. So naturally she became deathly ill and the baby was extremely underdeveloped. She ended up having miscarriage a month ago, and has had a series of operations because of all the heath problems she's been having due to her condition. Not to mention that she has cancer that she has yet to get treatment for.

 

I do not see any legal grounds for me to get sued on in this situation. We are not married, we never lived together, our relationship ended months ago, and we technically never had a child together.

 

My ex being the idiot she is, is probably going to think that she can get me under child-support laws which is ridiculous, because child-support laws don't come into effect unless there is an actual "child".

 

Can anyone provide me with some information out there?

I don't think it's a good idea for them to spend more money trying to put up a case against you. I'm not a lawyer, but you should be ok as long as the system doesn't bend you over. You don't have to, but you should try and help her (I'm sure you have been). I'm sure in time this will all be behind you.

I've helped her a lot during the summer, which is when i make most of my money, because my job is seasonal. I think I gave her about 3-4 grand last year, which is a lot seeing how i only made 7.

 

But lately I've been getting horrible pay and I myself am falling behind on my bills. But apparently thats no good for her, she wants money now.

 

And yea in time this will be all behind me, because her doctors say she has a 50/50 chance of living past this May if she gets treatment, which is isn't doing.

If she's trying to get you w/ Child-Support laws, then shes SOL.

 

Child Support is meant to going directly to the child's benefits which means a child must have been born or present. If there is no child, then there is no expenses for the child that must be paid by the second parent.

 

If she wants money from you, then going through the court system isn't going to work at all.

I would check the state in which you reside. I would also ask where exactly does she plan to establish that you have a financial responsibility to her?

 

Have you previously agreed to pay her bills? Is she doing something in return for the payment of these bills? Are you her guardian?

 

While I cannot offer you legal advice legally (no pun intended), I'll make a "classroom comment" and would say that this seems as if they are trying to frighten you into doing something by abusing threat of legal process.

I have no legal connection with her no marriage/guardian. I have helped her pay for her bills in the past by giving her money, I have never payed any of her actual bills I only gave her money. There has been nothing documented or anything about our transactions or documented agreements, for all the law knows is that I've never seen her in my life. I am from New Jersey if that accounts for anything, I don't think my state has any special laws.

 

The grounds from which she is trying to establish financial responsibility is on the grounds that I had got her pregnant. Most of these bills are for surgeries that she had performed due to her being pregnant and the fact that she has a genetic mutation not allowing her to carry a child. I do not believe that there are any laws requiring me to give "her" any money due to this situation. Even if my child survived, the court would order me to pay her to care for the baby, she would not be able to use the money for her hospital bills anyways.

 

Seeing how we didn't have a baby nor are we legally bound in any ways I am assuming that she has no case on me.

Like I said dude, I cant give you advice legally, as I am not yet an attorney but we can openly debate the issue here on the forum.

 

Child support is in support of an existing child, no child-no support.

 

Support payments are a seperate thing and must be established by the person requesting them as a need, and then the court must grant them.

 

Paladin is pretty on the ball here, I doubt she would be able to get a "give me money now" card from the court.

 

Again, however, I reiterate that this is not legal advice, as we are all just talking on the subject.

 

Is she alleging you got her preggo against her own will?
