once again still assuming we pay for license fees, if we keep it in-house i seriously doubt anybody is going to give a fuck, but that's not my call.

 

Only takes one report to get fucked over by something like that. Not gona risk it, sorry.

 

As Swede said, the people of epic weren't paying anymore and they were behind a lot of money to pay for targets. This doesn't include the fact they had events irl which would of probably brought in some money, but even then they were still losing. I just don't have the confidence in an idea like this money wise or participation wise.

Tbh all it would take is one report of Virus's balls going around to get fucked over for distributing to minors lol (not that I honestly give a shit, I'm just saying). I don't really care enough about this idea and figured it was probably the response it would receive, but the reasoning is kind of dumb when we don't exactly do everything legal as it is.

Technically it definitely is not lmao, if somebody made a report to whatever the specific agency that deals with kiddie porn / minors involving sexual content saying (and showing the blatant proof that anyone could access via our website & they might be two different agencies, I'm not sure without googling it) that somebody is showing their genitalia to minors, there could probably be legit consequences.

 

It doesn't bother me at all, it just amazes me as to how that would get overlooked but we're up in arms when it comes to music copyright (but we condone the "illegal" discussion of how to obtain it for free).

There won't be any legal consequences for a user-posted soft-nudes.

The only thing that would happen is the host either emails the owner of the website and telling him to keep a closer eye to the content that is being posted on our forums (This is usually the first thing they do, unless the host is VERY strict) OR they will just simply suspend the webhosting (indefinite for breaking TOS or temporarily to remove the nudes).

 

If the nudes was posted by the OWNER of the website, then that could bring in legal consequences (unless the host's TOS allows +18 content).

847.0138 Transmission of material harmful to minors to a minor by electronic device or equipment prohibited; penalties.—

(1) For purposes of this section:

(a) “Known by the defendant to be a minor” means that the defendant had actual knowledge or believed that the recipient of the communication was a minor.

(b) “Transmit” means to send to a specific individual known by the defendant to be a minor via electronic mail.

(2) Notwithstanding ss. 847.012 and 847.0133, any person who knew or believed that he or she was transmitting an image, information, or data that is harmful to minors, as defined in s. 847.001, to a specific individual known by the defendant to be a minor commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(3) Notwithstanding ss. 847.012 and 847.0133, any person in any jurisdiction other than this state who knew or believed that he or she was transmitting an image, information, or data that is harmful to minors, as defined in s. 847.001, to a specific individual known by the defendant to be a minor commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

 

 

(6) “Harmful to minors” means any reproduction, imitation, characterization, description, exhibition, presentation, or representation, of whatever kind or form, depicting nudity, sexual conduct, or sexual excitement when it.

 

 

You can put it any way you want, it's still illegal...and the fact it's in the open, posted about, and acknowledged is just further proof of negligence lol. And I seriously don't want it to be looked at like I care - because I don't, but it's pretty funny how distributing it around where minors are on our forums where we have no warning at all about anything of the sort is cool, but as soon as somebody suggests music piracy everybody is a saint all of a sudden lol.

Music piracy is known to all, but mostly for own use. Using music without paying for the rights on an internetradio that unknown people can listen to is illegal. Tbh, it was a bad idea the moment you suggested it in the open for everybody to see, since we now know it could be illegal.. All it takes is one little bastard or a banned member with an alt account to fuck Steamgamers up.

 

It's a big risk and if it consumes so much money, there shouldn't even be consisered to do this.. Because SG lives off it's servers,and those are perfect as they are. What do we want exactly? An internal radiostation or more and better servers? If anything should be done, it should be the expansion of our playerbase by making new servers for fresh games.

The only way around the whole legality issue without getting licenses right away, is to only play songs that we are allowed to get for free (With permission of the artist, of course), namely those songs under the Creative Commons license. That is, until we raise enough money to get licenses to the larger songs.

I'm sure we can find a bunch of songs of varying genre that fall under that criteria. All it would require is searching.
